We're making some changes to our organization, and we've updated our agreements, Terms of Service, and privacy documents to reflect them. If you signed up to Evernote before October 1, 2026, the changes take effect on December 1, 2026. For all other users, the changes are immediately effective.
Here's a short guide to what's changing.
1. Who you're contracting with
Your contract with us will be transferred to our affiliate, Bending Spoons Operations S.p.A., an Italian company headquartered in Milan.
Nothing about your Evernote experience is changing — same account, same notes, same plan. You may see a different company name providing the service and you should send notice to a different company now.
2. Which terms apply to you
Our legal terms now come in two versions: one for users residing in the European Economic Area, the UK, and Switzerland, and one for users residing everywhere else. Evernote Enterprise customers are covered by the second version, wherever they are based.
- European Economic Area, UK, and Switzerland. The terms are governed by Italian law, no longer include an arbitration agreement, and include the provisions required by European consumer law, which apply to you if you are a consumer.
- Brazil. Your contract is no longer with Evernote do Brasil Serviços de Aplicações Ltda and is no longer governed by Brazilian law. The same terms that apply to all other users outside the European Economic Area, the UK, and Switzerland now apply to you, including their governing law and arbitration agreement.
- Everywhere else. The governing law and dispute resolution rules that apply to you are unchanged.
3. Using Evernote
- One set of rules for our apps. The separate software license terms for the Evernote applications are now part of the Terms of Service.
- What is and isn’t allowed. We rewrote our User Guidelines to set out more clearly what is and isn't allowed, and updated how you can report illegal or non-compliant content, how we notify you about our decisions, and how you can challenge them.
- AI features. What you provide to features that use artificial intelligence, and the results they generate, are yours. We don't use them to train AI models.
4. Payments and subscriptions
We clarified how billing and subscriptions work and what happens if a payment fails, and confirmed that Evernote Points are no longer issued.
Your plan, price, and renewal date don't change. If you still have unredeemed Evernote Points, contact our Customer Support team.
5. Privacy
We updated our Privacy Policy and our Region-Specific Information page. In particular, we've updated the wording of some sections and clarified how your data is used when you use Evernote AI features. The content of our Cookie Notice is now part of the Privacy Policy, and we clarified how to manage your preferences through the new “Your Privacy Choices” link.
6. When the changes take effect
If you signed up to Evernote before October 1, 2026, the transfer of your contract and the updated documents take effect on December 1, 2026. Until then, the current versions continue to apply to you.
If you have a valid separate Order Form or custom agreement with us, its specific terms remain in full force for their duration. The updated documents apply to everything it doesn't cover from December 1, 2026.
By continuing to use Evernote after December 1, 2026, you're accepting the updated agreements and Terms of Service and acknowledging receipt of the updated Privacy Policy and other privacy documents. If you don't agree, please stop using the Evernote Service and close your account before December 1, 2026.
